Senior Manager, Senior Counsel - Consumer & Small Business Legal

An amazing opportunity exists for an experienced attorney to join Capital One's Consumer & Small Business Legal team. In this multi-faceted business counsel role, you will advise our Small Business Bank as they build the real-time, intelligent bank that small businesses need to win in the marketplace, and you will also advise our Customer Protection team of "fraud fighters" as they protect our Retail Bank customers from bad actors.

Our Small Business Bank is a full-service bank that meets all the needs of businesses with $2 million-$2 million in annual revenue. Our Small Business Bank plays a key role in supporting Capital One's broader strategy by acquiring new customers and deepening existing customer relationships to help position Capital One as the primary bank for its clients.

Our Retail Bank Customer Protection Team is responsible for developing strategies and defenses to protect Capital One and our consumer and small business customers from various forms of fraud. Fraud fighting is an extremely important function within Capital One, and the rapid advance of AI tools in the hands of fraudsters continues to raise the stakes for this work.

In this role, you will be a key legal and strategic advisor to Small Business Bank and Customer Protection business partners as they develop well-managed solutions to complex business problems. And you'll do it all in a collaborative, supportive environment that values your insight, promotes continuous learning, and rewards strategic and creative thinking.

As business counsel, you will:

  • Provide day-to-day business counsel advice and support to:

    • the Business Banking and Lending teams in the Small Business Bank

    • the fraud strategy and operations teams in Customer Protection

  • Partner closely with other Compliance and Risk advisors to drive comprehensive and consistent support

  • Partner internally with other business counsel and legal subject matter experts to drive consistency and best practices across Capital One's lines of business

  • Collaborate with our in-house Retail Bank Litigation team to manage litigation matters

  • Manage and coordinate outside counsel in an effective and efficient manner

  • Review and enhance associate-facing policies and procedures

  • Review and enhance customer-facing communications

  • Assist in monitoring and supervision of key third-party relationships

  • Advise on Retail Bank escalated complaints

Basic Qualifications:

  • Juris Doctor from an accredited law school

  • Active member in good standing of at least one state bar

  • At least 4 years of experience as an attorney in a law firm, in-house legal department, or government agency

Preferred Qualifications:

  • 5+ years of experience as an attorney in a law firm, in-house legal department, or government agency involving regulatory experience, with specific experience in advising bank depository and lending business teams

  • Specific familiarity with UDAAP, Reg E, Reg CC, NACHA, UCC Articles 3 and 4, BSA/AML/KYC, Privacy, etc.

  • Ability to identify and assess legal risks presented by a complex business model, and to communicate those risks to business partners

  • Ability to work in a dynamic environment and flexibility to adapt to changing needs

  • Ability to build collegial and effective relationships with attorneys, business managers, creative teams, analysts, project managers, and corporate compliance and risk professionals, and work cooperatively to resolve issues smoothly and quickly

  • Ability to prioritize a significant volume of work and to manage multiple, simultaneous deadlines

  • Excellent communication skills with the ability to influence others

This role is hybrid meaning associates spend 3 days per week in-person at one of our offices listed on this job posting. Fridays are enterprise- wide virtual work days. Monday, Tuesday, Wednesday and Thursday are options for in-person days for associates to spend time together working in our beautifully-designed team areas.

The minimum and maximum full-time annual salaries for this role are listed below, by location. Please note that this salary information is solely for candidates hired to perform work within one of these locations, and refers to the amount Capital One is willing to pay at the time of this posting. Salaries for part-time roles will be prorated based upon the agreed upon number of hours to be regularly worked.

McLean, VA: $193,000 - $220,300 for Sr. Manager, Sr. Counsel Richmond, VA: $175,500 - $200,300 for Sr. Manager, Sr. Counsel

Candidates hired to work in other locations will be subject to the pay range associated with that location, and the actual annualized salary amount offered to any candidate at the time of hire will be reflected solely in the candidate's offer letter.

This role is also eligible to earn performance based incentive compensation, which may include cash bonus(es) and/or long term incentives (LTI). Incentives could be discretionary or non discretionary depending on the plan.
